| I'd agree that its not over. In our last meeting with SFLC, Eben seemed pretty confident there would be nothing BB could recover from the Patent, despite Matthew Small's confidence that they could.The final decision may be a ways aways, but Eben thinks it is just a formality. As for D2L, it remains to be seen what will happen there. Small insists that the suite will stand regardless of whether the patent is dismissed. I find that hard to swallow from an ethical point of view, and I find it hard to believe a court would allow the suit to stand, when the basis it has been overturned. It would be like continuing to hold a wrongly convicted criminal, despite finding evidence of that person's innocence. Though our relationship with SFLC has ended, they are still on the case, and should it become apparent that BB wishes to continue to pursue the patent, or create additional patents, SFLC is still there to be sure they behave themselves.
